The new age in titles registration
As homeowners, we strive to pay off our mortgages and one day obtain a copy of our Title Deed, officially known as a Certificate of Title. That little bit of paper that says your castle is yours. Well not anymore.
The Queensland Titles Registrar has recently announced that as of 1 October 2019, Certificates of Title will have no longer have any effect. Therefore, if you or your mortgagee has previously requested a certificate of title then the protection from fraud that the certificate of title offers will be lost as of 1 October 2019.
The Queensland Titles Registry will retain its stringent witnessing requirement when signing any title office documents with that being the witness must be a ‘qualified witness’. This being either a solicitor, barrister, justice of the peace or a commissioner of declarations. These qualified witnesses should already have proper processes in place to ensure that the persons signing any titles office documents ara the rightful person to do so.
